Website terms only
These terms govern use of this website. They are not a service agreement, binding offer, quotation, statement of work, or promise that a particular result can be achieved. Submitting a form or contacting us does not create a client relationship or an obligation for either party to proceed. Client work is governed by a separate written agreement covering scope, fees, responsibilities, deliverables, and support.
Website information
We work to keep website information useful and current, but it is provided for general information and may contain errors, omissions, or outdated material. Use of the website and reliance on its information are at your own discretion. We may change, suspend, or remove website content or features without notice.
Acceptable use
Do not interfere with the website, attempt unauthorized access, misuse a form, submit fraudulent or malicious material, impersonate another person or business, introduce malware, or use automated requests in a way that disrupts or places an unreasonable load on the website.
Working with third-party platforms
Some website features and client work may involve software, advertising, hosting, analytics, AI, CRM, or other third-party platforms. Those platforms have their own terms, pricing, availability, security practices, and service changes. Unless a written agreement says otherwise, you are responsible for maintaining your accounts, permissions, subscriptions, and compliance with their terms.
Your responsibilities
You are responsible for the accuracy, legality, and rights to use the content, data, brand assets, and instructions you provide. You are also responsible for obtaining any notices, consents, approvals, and permissions required for your business, customers, employees, marketing, and connected systems.
Intellectual property
The website’s content and design, including the N49 name and marks, are owned by or licensed to N49 Technologies Inc. You may view and use the website for ordinary personal or internal business purposes. Do not reproduce, publish, sell, or reuse its content without our written permission. Ownership and use rights for client deliverables are set out in the applicable written agreement.
Third-party links
Outbound links are provided for convenience. We do not control or endorse those services and are not responsible for their content, availability, security, terms, or privacy practices.
Limitation of liability
To the fullest extent permitted by law, N49 Technologies Inc. is not liable for indirect, incidental, special, consequential, or similar damages arising from use of this website, its unavailability, or reliance on its general information. Nothing in these terms excludes or limits a right or liability that cannot lawfully be excluded or limited.
Governing law and venue
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Any proceeding relating to these terms or the website will be brought in the courts of Ontario unless applicable law requires otherwise.
Severability and waiver
If any part of these terms is found unenforceable, the remaining terms continue to apply. A failure to enforce a term is not a waiver of that term or the right to enforce it later.
Changes
We may revise these terms at any time. The date above identifies the current version.
